Conditions of Permanent Residency

Upon green card approval by the USCIS, investors are granted permanent residence on a conditional basis for a period of two years. At the expiration of this two-year period, the permanent residency expires and the applicant may be deported.

In order to avoid this condition, the applicant must file an I-829 Petition by Entrepreneur to Remove Conditions. This petition can be filed 90 days or less before the expiration date of their conditional residency. Upon the USCIS’s confirmation that all requirements of the EB-5 program have been met, all conditional requirements will be removed.

In order to maintain permanent residency, an applicant cannot place himself in a position in which the government may deem him/her removable or prohibited. The conviction of a crime would qualify a green card holder for removal.

An applicant cannot leave the United States with the intention of abandoning it as their place of permanent residency.
